Court Strikes Down Biden Admin’s Attempt to Reinstate U.S. Navy’s COVID-19 Vaccine Order

A federal appeals court denied a motion by the Biden administration seeking to reinstate an unconstitutional vaccine mandate on elite members of the US Navy.

 

After a US district court in January granted a preliminary injunction allowing the Navy officers to refuse the mandatory experimental Covid vaccine, the Biden admin moved to appeal the decision.

In a denial of the appeal issued Monday by the U.S. Court of Appeals for the Fifth Circuit, the court argued the Biden administration’s job-for-jab scheme would cause “irreparable harm” to service members’ First Amendment rights by forcing them to get vaccinated with no reasonable medical or religious exemption option.

 

 

“The loss of First Amendment freedoms, for even minimal periods of time unquestionably constitutes irreparable injury,” the court wrote citing Opulent Life Church v. City of Holly Springs Miss.

 

“At base, Plaintiffs are staring down even more than ‘a choice between their job(s) and their jab(s),’” the court wrote. “By pitting their consciences against their livelihoods, the vaccine requirements would crush Plaintiffs’ free exercise of religion.”

 

In their lawsuit last November, the plaintiffs argued their freedom of religion was violated by the fact the vaccines were developed and tested using aborted fetal cell lines, and took issue with the “mRNA vaccines’ altering [of] the divine creation of their body by unnaturally inducing production of spike proteins.”

 

Despite having a “six-phase, 50-step process in place to adjudicate accommodation requests,” the appeals court judges wrote, “The Navy has not accommodated any religious request to abstain from any vaccination in seven years, and to date, it has denied all religiously based claims for exemption from COVID-19.”

 

“But evidence suggests that the Navy has effectively stacked the deck against even those exemptions supported by Plaintiffs’ immediate commanding officers and military chaplains,” the judges added.

Speaking to CBN, First Liberty Institute counsel Mike Berry, who represented the Navy service members, praised the appeals court’s decision for protecting the US Constitution.

 

“Forcing a service member to choose between their faith and serving their country is abhorrent to the Constitution and America’s values,” Berry said. “Punishing SEALs for simply asking for a religious accommodation is purely vindictive and punitive. We’re pleased that the court has acted to protect our brave warriors before more damage is done to our national security.”

 

“Events around the world remind us daily that there are those who seek to harm America. Our military should be welcoming service members, not forcing them out because of their religious beliefs.”

 

The Navy admitted last month it discharged over 240 service members for refusing to take the Covid-19 jab.
