Sorry folks, nothing has changed with Feinsod’s City of Venice mask mandate

I was approached last night while out and about without my mask.  Some elderly lady decided to tell me that I am breaking the law by not wearing a mask in the City of Venice.  I told her that she is right that an ordinance passed, but she was wrong that I was in violation.

 

You see, this nice lady thought that the passage of the ordinance meant that everybody would be wearing a mask at all times.  I explained to her that there were several exceptions and basically nothing has changed.   It was just the Mayor trying to score political points pushing out an ordinance that the VPD and council members agreed that has to many holes and will do nothing to make people wear mask.  She asked which exception allowed me not to wear a mask in the store.  I explained that I am claiming a medical exception.  She asked if it could be proven and when I told her that the officials or individuals are not allowed to ask for proof over HIPAA issues, she was amazed and stated that anybody can go without a mask then……. She was very disappointed that the City of Venice would push an unenforceable mandate that was essentially meaningless and that the Mayor would lead citizens to believe that everybody would be walking around with a mask. I made a point of telling her everyone that voted for it and how the decision was made primarily because of a letter from the political leadership at Sarasota Memorial and not scientific facts that I presented to them from epidemiologist and many studies. She was simply amazed.

 

Based upon that conversation, I thought I would break down the exceptions which will illustrate that nothing has changed.  Basically, all it does is mandate mask outside when you can’t socially distance and inside businesses within the City of Venice limits.  However, if you have a medical exemption or meet any of the exceptions below, you do not have to comply with this rule.  All of these exceptions make this ordinance unenforceable, according to the VPD Chief.

 

• Persons observing physical or social distancing; and
• Persons eating or drinking; and
• Persons inside of motor vehicles, except that persons inside of vehicles-for-hire shall be required to wear face coverings; and
• Schools or daycare facilities, which may apply their own public safety policies and procedures; and
• Governmental facilities, including but not limited to police and fire stations and administrative offices which may apply their own public safety policies and procedures; and
• Persons inside in a hotel room, motel room, vacation rental, or similarly situated accommodation which is not accessible to the public. This exception does not extend to the common areas of the lodging establishment, including but not limited to lobbies, elevators, meeting rooms, restaurants, bars and event spaces.
• If a person is under the age of six, use of a face covering is left to the discretion of that person’s parent, guardian, or accompanying adult. Persons under the age of two are not required to wear a mask under any circumstances as CDC guidelines state that a face covering is not appropriate for this age group; and Page 5 of 7, Ord. • Persons whose compliance would be detrimental to their health, safety, or welfare. If this exception is being asserted for health reasons, the person asserting this exception is not required to carry or produce documentation verifying the heath condition or to specifically identify the health condition to the compliance officer or law enforcement officer; and
• Persons working in a business or profession who do not have interactions with other persons; and
• Persons working in a business or profession who maintain social distancing from another person; and
• Persons working in a business or profession where use of a face covering would prevent them from performing the duties of the business or profession; and
• Persons exercising, while maintaining social distancing; and
• Public safety, fire and other life safety and health care personnel, as their personal protective equipment requirements will be governed by their respective agencies; and
• Persons communicating with a hearing-impaired person who needs to see the person’s mouth to communicate.

 

So, nothing really has changed, especially since just about all the businesses were already mandating mask.
