Texas AG Sues Biden Admin Over Airplane Mask Mandate

The Biden administration’s mask requirement on flights is illegal and unconstitutional, Texas Attorney General Ken Paxton wrote in a federal complaint.

 

On Wednesday, Paxton unveiled a lawsuit on behalf of US Congresswoman Beth Van Duyne (R-Texas) listing CDC Director Rochelle Walensky, her chief of staff, Sherri Berger, and the Health and Human Services Secretary Xavier Becerra as defendants.

press release on Paxton’s website describes the CDC’s airline mandate as “unlawfully issued,” and notes the requirement was “not authorized by Congress, and the CDC did not put the mandate up for notice and comment, which is ordinarily required for regulations like this.”

 

 

The lawsuit argues against the purported effectiveness of masks, stating that the mandate “provides no findings that show masks have limited the interstate spread of COVID-19 through conveyances and transportation hubs.”

 

It also notes the mask order violates Gov. Greg Abbott’s executive orders, which “determined that Texans can choose for themselves whether to wear masks and that Texas businesses cannot be required by State or local governmental entities to impose masking requirements.”

 

“Defendants’ Mask Mandate encroaches on the authority of the State within its jurisdiction, even as to purely intrastate travel,” the suit argues.

 

Additionally, the mandate is unconstitutional as it unlawfully grants the CDC legislative authority, powers reserved for the US Congress, the lawsuit states.

Referring to the complaint Wednesday, Paxton declared, “Biden’s repeated disregard of the individual liberties of Texans is not only disrespectful to the U.S. Constitution, it is also troublesome that any president thinks they can act above the law while hardworking Americans standby.”

 

“President Biden cannot continue governing through executive edicts. Now is the time to strike down his administration’s air-travel mask mandate. I’m proud to stand alongside my friend Congresswoman Van Duyne and her counsel at TPPF to protect Texans’ liberty and the rule of law.”

 

Congresswoman Van Duyne tweeted Wednesday, “Sued the CDC today. Masks on planes are unnecessary. Thanks to @TPPF for helping make this happen so we can continue the fight to end mandates and bureaucratic control of American lives!”

 

The lawsuit came as CDC Director Walensky on Wednesday noted the agency was looking at “soon” releasing new Covid-19 guidance, including on face masks.

 

“We want to give people a break from things like mask wearing when these metrics are better and then have the ability to reach for them again should things worsen,” she stated.
