Suncoast man gets 50 years after being convicted of Sexual Battery of a Person Physically Helpless to Resist.

State Attorney Ed Brodsky announced today that 46-year-old Leonicio Diaz was sentenced this week to 50 years in the department of corrections after being convicted during a July jury trial of Sexual Battery of a Person Physically Helpless to Resist.

 

The defendant was previously convicted of a sexual offense in 1998, Lewd, Lascivious or Indecent Act Upon a Child Under 16 Years of Age and was already a designated Sexual Offender. Due to this being his second conviction for a sexual offense, he was deemed a Dangerous Sexual Felony Offender under Florida Statute §794.0115 and was subject to a minimum-mandatory sentence of 50 years in prison for this offense.

 

The lead prosecutor in the case, Assistant State Attorney Ashley Dusnik commented, “The victim in this case found herself in an incredibly difficult situation, discovering she was pregnant due to the sexual battery she endured at the hands of this defendant. The State commends her bravery in coming forward and telling her story to law enforcement and the members of the jury. We appreciate the efforts of law enforcement, specifically Det. Rhonda Ellis of the Manatee County Sheriff’s Office, in securing this conviction, as well as the patient and careful consideration provided by the members of the jury. This 50-year sentence will ensure that this defendant can no longer pose a sexual threat to our community”
