CDC Gives DOJ Greenlight to Appeal Ruling that Ended Mask Mandate

The Centers for Disease Control and Prevention (CDC) gave the U.S. Department of Justice (DOJ) the green light to appeal a ruling by a federal judge that ended President Joe Biden’s mask mandate at airports and other federal transportation.
The CDC said in a statement:
To protect CDC’s public health authority beyond the ongoing assessment announced last week, CDC has asked DOJ to proceed with an appeal in Health Freedom Defense Fund, Inc., et al., v. Biden, et al. It is CDC’s continuing assessment that at this time an order requiring masking in the indoor transportation corridor remains necessary for the public health. CDC will continue to monitor public health conditions to determine whether such an order remains necessary. CDC believes this is a lawful order, well within CDC’s legal authority to protect public health.
The CDC’s Wednesday announcement comes two days after U.S. District Judge Kathryn Kimball Mizelle ruled the federal travel mask mandate was unlawful. On Tuesday, Biden’s DOJ announced it would appeal the judge’s decision only if the CDC felt the mask mandate was still required.
