The State of Florida recently passed a law making it legal to shoot fireworks which leave the ground and/or explode on the 4th of July, New Years Eve, and New Year’s Day. However, the law specifically states that the change does not supersede local law or even Home Owner Association rules.
In the City of North Port, a permit is required to set off these types of fireworks. The City is not issuing any permits except to professional pyrotechnic companies that are licensed and insured. We will be seeking guidance in the future from our governing body to determine if a change is needed but it is our position that keeping fireworks out of the hands of non-professionals is safer for the Citizens and properties in our City. The current weather conditions are not conducive to changing that position at this time either, as evidenced by the rash of lightning strike brush fires in our area just this week.

Here is the relating City Ordinances:
Sec. 26-21. – Required permits; issuance; fees; revocation.
(a) Operations that may require restrictions on permit. The authority having jurisdiction (AHJ) shall have the authority to comment and recommend restrictions on permits for the following operations within the district:
(12) Fireworks—Possession, storage, manufacture, sale, discharge, or pyrotechnic display within the City of North Port.
Sec. 46-41. – General prohibitions.
No person shall make, continue or cause to be made or continued any unusually loud, unnecessary or excessive noise which unreasonably annoys, disturbs, injures or endangers the comfort or repose of others within the corporate limits of the City of North Port, Florida.
